Delaware Electronic Notarization Law
To be able to electronically notarize documents, a Delaware notary is required to complete an education course for and register with the Secretary of State. The technology that will be used must be completed on the application. The notary must use an electronic notary signature and electronic seal that includes the notary’s title, state and expiration date.
The electronic seal and signature should be attached to the electronic document that will allow independent verification and prevents changes from being made to the electronic document. The electronic notary should only notarize an electronic document when the signer is present. The notary’s seal and electronic signature must remain under the notary’s control at all times. There is also a requirement that a journal be kept of all transactions.
